Mr.Ashok Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-01-2022 Heard both parties through video conferencing. The petitioner seeks bail in Nokha P.S. Case No. 71 of 2020, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the FIR, while the informant was at his shop one Ajeet Kumar came and purchased some articles and when informant demanded the price he threatened. Thereafter it is alleged that he along with other accused persons including petitioner variously armed came and started assaulting the informant. When the informant put the shutter of shop down they started indiscriminate firing and on intervention of local people two co-accused namely, Vikki Patel and Suraj Kumar were caught and handed over to the police.

No.45019 of 2021(2) dt.22-01-2022 2/2 It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case only on suspicion and no specific overt act has been alleged against this petitioner. Coaccused who was apprehended on the spot has been granted bail by this court vide order dated 17.06. 2021 passed in Cr. Misc. No. 3223 of 2021. Petitioner is in custody since 08.01.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas, Sasaram in connection with Nokha P.S. Case No. 71 of 2020.
