The petitioner is languishing in jail since 12.08.2015 in a case instituted under Sections 147, 148, 149, 342, 364 and 452 of the Indian Penal Code and Section 27 of the Arms Act as also Section 17 of the CLA Act.

As per prosecution case that 20 to 25 unknown MCC extremists caught the son of the informant from his house after being surrounded. They took away his son after entering inside the house.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.08.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of

Patna High Court Cr.Misc. No.43399 of 2015 (3) dt.10-11-2015 evidence against the petitioner. Petitioner has got no criminal antecedent. The victim is said to have been recovered. Petitioner is not named in the FIR. The name of the petitioner has come on the basis of a confessional statement of a co-accused. Except for that, there is no other material to suggest his implication in the present case.

On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghati (Gaya) in connection with Raushanganj (Bankey Bazar) P.S.Case No.12 of 2000, G.R.No.209 of 2000.
