JUSTICE RAKESH KUMAR ORAL ORDER 16-02-2016 Heard Sri Nagendra Kumar Singh, learned counsel for the petitioner and Sri Manoj Kumar, learned A.P.P. The petitioner apprehending his arrest in connection with Shahkund P.S. Case No. 180 of 2015 registered for the offence under Section 25 (1-B)/ 26 of the Arms Act has prayed for grant of anticipatory bail.

It has been argued by learned counsel for the petitioner that it was alleged that from the house of the petitioner beneath the bed one country made double barrel gun and cartridges were recovered. It has been argued that copy of seizure list was not handed over to any of the family members of the petitioner whereas a specific stand has been taken in the present petition that the petitioner was living jointly with his wife. On this ground a prayer has been made for extending the privilege of anticipatory

Patna High Court Cr.Misc. No.1109 of 2016 (3) dt.16-02-2016 2/2 bail.

Learned A.P.P. has opposed the prayer of bail. He submits that while search was being conducted the petitioner fled away and from his house aforesaid double barrel gun and cartridges were recovered.

In view of the facts and circumstances, the court is of the opinion that it is not a case for extending the privilege of anticipatory bail.

The petition stands dismissed.
