JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302, 120(B), 34 of the Indian Penal Code and u/s 27 of Arms Act.
As per the prosecution case, husband of informant while coming back from a feast was accosted by five named accused persons along with 10 unknown persons and they fired upon the husband of the informant, due to which he died. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation but from perusal of the FIR it would be evident that specific allegation of firing is upon Navin Mandal, Mukesh Kumar, Nawal Yadav etc. Similarly situated accused, Rajeev Kumar Mandal and Banty
Patna High Court CR. MISC. No.46731 of 2021(2) dt.16-11-2021 2/2 Kumar Mehra, whose name also transpired during the course of investigation, have already been granted bail by co-ordinate Benches of this court vide orders passed in Cr. Misc. No. 26597/2020 and in Cr. Misc. No. 944 of 2021. Petitioner is in custody since 22.07.2020 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Abhimany Kumar J.M.F.C., Udakishunganj, Madhepura in connection with Bihariganj PS case No.372/2019.
