The petitioner is languishing in jail since 06.08.2015 in a case instituted under Sections 366A/34 of the Indian Penal Code. As per prosecution case, it is a case of abduction of informant's daughter aged about 13 years by the accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.08.2015. Chargesheet has been submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering of evidence against the petitioner.

As per the prosecution case, the victim girl is said to have taken away by the petitioner and one Ehtasam. A

No.43489 of 2015 (3) dt.26-11-2015 supplementary affidavit has been filed on behalf of the petitioner where the Nikahnama has been brought on record showing that the victim girl has married with co-accused Ehtasam. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Araria in connection with Jokihat P.S.Case No.369 of 2014, G.R.No.3730 of 2014.
