Vide order dated 10.10.2022, notices were issued upon O.P. No. 2. It transpires from record that the requisites etc. for sending notices upon O.P. No. 2 on both the processes (Talwana with Goshwara and speed post with A/D) have been filed. The service report of Talwana has been received by which it transpires that the notice has been validly sent through subsequent service whereas the registered speed post has been returned undelivered with acknowledgment that the receiver is residing outside the house without present address. In this view of the matter, let the notices is hereby validly served.

Learned counsel for the petitioner submits that vide

Patna High Court CR. MISC. No.36778 of 2022(3) dt.20-12-2022 2/2 order dated 10.10.2022, provisional bail has been granted to the petitioner considering the merit of the case and matter was fixed for hearing for O.P. No. 2 who has not opted to appear here. In the present facts and circumstances of this case and the submissions made above, let the provisional bail granted to the petitioner is hereby confirmed and the present application is disposed off.

With this observation, the bail application stands disposed off.
