The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.
Seven unknown miscreants are said to have descended at the jewellery shop of the informant and looted away several silver, golden and diamond ornaments worth Rs.1.5 crores on the point of firearm.
It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. There is nothing cogent in the record indicating the complicity of the petitioner in the occurrence
Patna High Court CR. MISC. No.33276 of 2019(2) dt.20-05-2019 2/2 barring the confessional statement of the petitioner and that of co-accused Mohammed Rahamtullah which has no evidentiary value in the eye of law. There is no eye witness of the occurrence. He has been languishing in custody since 07.03.2019.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Hajipur Town P.S.
