JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-08-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Case No. 199 of 2018 arising out of Khagaria (Muffassil) P.S. Case No. 569 of 2016 for the offenses under Sections 364, 307, 504, 34 of the Indian Penal Code and Sections 26/27 of the Arms Act.
Learned counsel for the petitioner submits that allegation of firing is against co-accused Rajiv Kumar. He submits that similarly circumstanced co-accused Sanjay Singh, Rajendra Ram and Sanjiv Kumar have been granted bail by different co-ordinate Benches of this Court. The petitioner is in custody since 6.3.2018.

Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IV, Khagaria in connection with Sessions Case No. 199 of 2018, arising out of Khagaria (Muffassil) P.S.
