The petitioner has prayed for bail in a case registered for the offence punishable under sections 494, 304(B), 120(B), 34 of the Indian Penal Code.

As per allegation in the FIR, petitioners along with his family members has tortured in various ways to the sister of the informant due to non-fulfillment dowry demand and ultimately they killed her for want of dowry.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is mother-in-law of the deceased and she has been falsely implicated in this case. She has never demanded any thing from the deceased. She has no concern

Patna High Court CR. MISC. No.36364 of 2023(2) dt.23-06-2023 2/2 with the daily activity of the deceased and her husband. She is living separately. In fact, deceased died due to illness. Similarly situated other accused persons have already been enlarged on bail by another Bench of this Court vide order dated 16.5.2023 passed in Cr. Misc. No. 72553 of 2022. The sole responsibility to take care of wife is upon husband and against the family members. Husband is in custody. Petitioner has got no criminal antecedent and languishing in judicial custody since 13.3.2023. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMI, Supaul in connection with Triveniganj P.S. Case No. 337 of 2021.
