Petitioner apprehends arrest in connection with Chainpur P.S. Case No. 92 of 2019 registered for the offence punishable under sections 304B/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner, who is father-in-law of the deceased, has falsely been implicated in this case merely on suspicion. As a matter of fact, the deceased met with an accident while cooking. She was taken to hospital as is evident from the medical receipts contained in Annexure-2, but in course of treatment she died. The informant getting knowledge about
Patna High Court CR. MISC. No.34204 of 2019(4) dt.08-08-2019 2/2 the truth, has filed a compromise petition in the Court below vide Annexure-3. Petitioner is an old man having no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, II, Kaimur, Bhabua in connection with Chainpur P.S. Case No.m 92 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
