JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-07-2022 The present writ petition has been filed seeking the following reliefs:- "i) For issuance of appropriate writ in the nature of mandamus seeking direction to respondents to stop filling/destroying of survey Karha which was prepared in the financial year of 2017-18 by the government for micro irrigation work in the village-Itaur, P.S. Charpokhari but the same is being filled up for construction of non metallic road by political people of the village in connivance with Anchal staff and the petitioner and large number of other villagers have been deprived by using of water in to his field for

ii) For issuance of appropriate Writ in the nature of mandamus seeking direction to respondents to hold an enquiry and take action against anti social element who by taking law in their own hand have destroyed village karha and also connected survey karha which was main source of irrigation in the village."
At the outset, the learned counsel for the petitioner seeks liberty to approach the District Magistrate, Bhojpur at Ara for redressal of his aforesaid grievance, however, seeks a direction upon the respondent no. 6 to stop filling/destroying survey Karha.
Accordingly, the present writ petition stands disposed off with liberty to the petitioner to file appropriate representation before the District Magistrate, Bhojpur at Ara within a period of two weeks from today, who shall consider the case of the petitioner and after making appropriate enquiry and after hearing the parties, shall pass appropriate orders within a period of 12 weeks, thereafter.
It is needless to state that in case the petitioner appears before the District Magistrte, Bhojpur at Ara within a period of two weeks from today and files appropriate representation, the District Magistrate, Bhojpur at Ara shall
