The petitioner seeks bail in Gopalpur P. S. Case No. 426/14 registered for the offence under Section 302 and other sections of the Indian Penal Code.

The brother of the deceased Shankar Kumar Choudhary alleged that his brother went along with Vijay Kumar Singh, but after sometime he got information that his brother was shot dead. The informant suspected that Ajay Kumar Choudhary killed his brother only because his brother forcibly kidnapped his daughter. The petitioner is not named in the FIR. The name of the petitioner is figured in the confessional statement of chowkidar namely Hari Paswan and Brahmadeo Paswan who stated that they

Patna High Court Cr.Misc. No.45728 of 2015 (2) dt.01-10-2015 2/2 heard rumour in the village that Navin Yadav, Gandhi Yadav and petitioner killed Pinku Choudhary. Thereafter, the petitioner on being arrested is said to have confessed before the police and disclosed that he along with other accused persons killed deceased. Save and except the confession of the petitioner the police did not collect any further material.

Considering the facts aforesaid, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Addl.
