ABHISHEK REDDY ORAL ORDER 08-07-2026 Learned counsel appearing on behalf of the petitioner submits that the matter is squarely covered by the Judgment of this Hon'ble Court passed in CWJC No. 13334 of 2025 dated 08.12.2025.

2. Learned counsel appearing on behalf of the Respondent-State as well as the learned counsel appearing on behalf of the Respondent-Madhya Bihar Gramin Bank do not controvert the above made submissions.

3. In this particular case, as evident from the records, the petitioner has purchased five cows on 19.03.2015 and the same was duly certified by the Veterinary Doctor, the Insurance Authority, and the District Cow Development Officer.

4. Having regard to the fact that the scheme came to an end on 15.08.2015, the petitioner is entitled to the subsidy in respect of the five cows that were purchased prior to 15.08.2015. This Hon'ble Court in CWJC No. 13334 of 2025 has held as under:- "8. Considering the rival submissions of the parties and the aforesaid discussions this Court comes to the conclusion that five cows were purchased by the petitioner prior to closure of scheme of subsidy and purchase of five cows made by the petitioner was duly certified by the concerned authorities.

9. Accordingly, I hold that the petitioner is entitled to be given subsidy at the rate 50% of the price of cows. The price of the cow comes to Rs. 1,75,000/- as such as per the scheme of subsidy the petitioner is entitled to be given Rs. 87,500/- as subsidy amount.

The petitioner in the circumstances is not entitled to be given any subsidy for purchase of another five set of cows after expiry of the scheme on 19.07.2016.

10. Resultantly, the State authorities

3/4 particularly the respondent no. 6 are directed to pay subsidy amount of Rs.

87,500 /- to the petitioner in his loan account within a period of two months from today. The Bank in turn is directed to adjust the subsidy amount deposited in the account of the petitioner by the respondent -State authorities and after recalculating the outstanding dues demand notice be issued to the petitioner for re-payment of the loan amount at the earliest.

5. Having regard to the above, the present writ petition is allowed to the extent that petitioner would be entitled subsidy at the rate of 50% of the price of the cows. The price of the cow comes to Rs. 1,75,000/- and as per the scheme of subsidy the petitioner is entitled to be given Rs. 87,500/- as subsidy amount. Accordingly, the Respondent-authority, more particularly, Respondent No 6 is directed to pay the subsidy amount of Rs. 87,500/- to the petitioner as expeditiously as possibly preferably within a period of 8 weeks from the date of receipt of a copy of this order. The Respondent-Bank is also directed to adjust the subsidy amount deposited to the account of the petitioner and after recaclulating the outstanding dues the revised demand notice be issued to the petitioner for re-payment

6. With the above observations and directions, the present writ petition stands disposed of.
