Petitioner seeks bail in connection with Rajiv Nagar P.S. Case no. 62 of 2021 registered for the offence punishable under section 414 of the Indian Penal Code read with sections 25(I-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is in custody since 15.2.2021, is person with clean antecedent and charge sheet has been submitted. Allegation is recovery of a country made pistol and one live cartridge and also motorcycle which petitioner along with co-accused was riding is alleged to be stolen.

Learned APP Sri Atul Chandra opposes the prayer for

Patna High Court CR. MISC. No.45948 of 2021(2) dt.22-12-2021 2/2 bail.

Considering the facts that petitioner is in jail custody since 15.2.2021, is person with clean antecedent and charge sheet has been submitted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate III, Patna in Rajiv Nagar P.S. Case no. 62 of 2021.
