2. The petitioner seeks regular bail in connection with Piro (Hasanbazar) P.S. Case No. 540 of 2023, lodged on 23.12.2023 under Section 394 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against 4 named accused persons including the present petitioner. Arms, live cartridges, mobile phones, motorcycle have been recovered which is the subject matter of the present case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the petitioner's name has been inserted in this case only at the instance of the police due to the reason that the

Counsel further submits that the criminal antecedent of the petitioner is not clean and there are six criminal cases pending against him. The petitioner is in custody since 23.12.2023 in the present case.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the criminal antecedent of the petitioner is not clean and this aspect may be taken into consideration while considering the bail application of the petitioner.

6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Piro (Hasanbazar) P.S. Case No. 540 of 2023, pending before the learned Additional Chief Judicial Magistrate-IV, Bhojpur at Ara is hereby rejected. (Dr. Anshuman, J.) Divyansh/- U T
