The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner but para 3 of the bail petition petitioner is an accused in Chakia P.S. Case No. 63 of 2016 under Sections 272/273 and Section 47 (a) of the Excise Act.
In the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Chakia P.S. Case No. 238 of 2018 from the Court of learned 7th Addl.
Patna High Court CR. MISC. No. 35839 of 2019(3) dt.13-08-2019 2/2 Sessions Judge cum Special Judge, Excise, East Champaran, Motihari.
Accordingly, the application is dismissed.
