JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Keoti P.S. Case No. 230 of 2018 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioner is that he assaulted the informant by means of sword, causing injuries to him. Submission of learned counsel for the petitioner is that there is specific allegation that he assaulted by means of sword but injuries found were caused by hard and blunt substance on the person of informant and there is case and counter case between the parties.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail on the ground that injury on head is grievous in nature.

Patna High Court CR. MISC. No.36334 of 2019(3) dt.14-08-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender an pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
