The petitioner is languishing in jail since 17.04.2015 in a case instituted under Sections 304B and 328/34 of the Indian Penal Code.

As per prosecution case, it is a case of murder of informant's married daughter by the accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.04.2015. Chargesheet has been submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering of evidence against the petitioner.

From perusal of the FIR, it is evident that the deceased

Patna High Court Cr.Misc. No.43565 of 2015 (3) dt.26-11-2015 had committed suicide at her Maika. As per the FIR, the petitioner wanted to take her, the deceased to Delhi but the deceased did not want to go along with the petitioner. There is no allegation of any demand of dowry made in the FIR.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Supaul in connection with Chhatapur P.S.Case No.265 of 2014.
