This application for anticipatory bail arises out of Chautham P.S. Case No. 110 of 2021 for the offence punishable under Sections 341, 323, 447, 308, 504 of the Indian Penal Code.
It has been submitted that the parties are agnates and the dispute has taken place on account of trivial issue, inasmuch as, the injury report is not on record. Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail till submission of charge-sheet on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st
Patna High Court CR. MISC. No.45762 of 2021(2) dt.23-05-2022 2/2 Class, Khagarai, in connection with Chautham P.S. Case No. 110 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that if the injury report is submitted showing that the injury sustained by the victim is simple in nature, then the anticipatory bail granted to the petitioner shall be confirmed by the Court below after submission of the chargesheet. If the injury report shows that the injury sustained by the victim is grievous in nature, in such a situation, the bail bonds of the petitioner shall be cancelled and he shall be taken into custody forthwith.
