ANSHUMAN ORAL ORDER 26-06-2025 Heard learned Counsel for the petitioner, learned Counsel for the Bihar Public Service Commission and learned Counsel for the State.

2. The present writ petition has been filed with the following reliefs:- "(i) For direction/order to the respondent no. 4 (Chairman) and

Patna High Court CWJC No.9676 of 2025(2) dt.26-06-2025 2/3 Respondent No.-6 (Examination Controller, BPSC) to publish the result of the petitioner bearing his Roll No. 119600 obtained the total marks 350 under EWS (Economically Weaker Section) candidate, the cut off marks of the result published concerning advertisement no. 18, 19, 20, 21/2024 and on the same cut-off marks other candidate was selected but in spite of vacant seat, the petitioner, he was not called for his selection.

(ii) For selection of petitioner is existing vacant seat under aforesaid advertisement.

(iii) Other remedy/remedies as your lordships may be pleased to deem fit and proper in the interest of justice to the petitioner."

Learned Counsel for the petitioner submits that this writ petition has been filed for issuance of mandamus and for which representation (Annexure-P/7) has been filed before the Secretary, Bihar Public Service Commission but till date no decision has been taken by the Bihar Public Service Commission, Patna, Bihar.

4. Learned Counsel for the Bihar Public Service Commission submits that a time may be framed to pass order on the representation.

5. In the light of the submissions, this writ petition is disposed off directing the Secretary, Bihar Public Service Commission, Bihar, Patna, to pass order on the representation (Annexure-P/7) within 90 days from the date of receipt/production of a copy of this order.

6. It is made clear that Court has not applied mind on the merits or demerits of the case and the authority shall pass order with a reason indicating the position of law. (Dr. Anshuman, J) Mkr./- U
