Mr.Md. Khurshid Alam, AAG12 ====================================================== CORAM: HONOURABLE MR. JUSTICE JYOTI SARAN and HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER (Per: HONOURABLE MR. JUSTICE JYOTI SARAN) 10-05-2019 Heard learned counsel for the petitioners and learned Assisting Counsel to AAG 12.
The writ petition is filed by way of a Public Interest Litigation to complain on encroachment on a public land which is stated to be recorded as a pond. For the present we find no reason to express any opinion on the complaint because the Jamabandi in respect of the pond land stands in the name of the beneficiaries under the Bihar Privilege Persons Homestead
Patna High Court CWJC No.2610 of 2018(4) dt.10-05-2019 2/2 Tenancy Act, 1947. We also take notice of the statement in the counter affidavit of the State which reflects that steps are being taken by the State in this regard for cancellation of Jamabandi of those settled.
In such view of the matter and in the circumstances noted, no cause for indulgence is made. The writ petition is disposed of.
