JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 47(a) of the Excise Act.

It is alleged that from the cold drink shop of the petitioner 70 liters of country made liquor were recovered. It is submitted by the learned counsel for the petitioner that petitioner has never been made accused in similar nature of offence and he has no criminal antecedent, as stated in paragraph 3 of the petition. There is nothing on record to suggest that the shop in question belongs to the petitioner.

The aforesaid facts constitute grounds for consideration

Patna High Court Cr.Misc. No.1581 of 2016 (2) dt.13-01-2016 2/2 of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with C-II 256/13 pending in the court of learned Chief Judicial Magistrate, Siwan.

This application is disposed of with the aforesaid observation/ direction.
