It is unfortunate that learned counsel for the petitioner who represents him in the case and has filed the application is himself not aware as to whether the petitioner has surrendered in the case. The situation is unfortunate. Learned counsel cannot accept the brief without accepting responsibility. Even basic facts which are expected and which learned counsel are obliged to be aware of are not available with them.

2. The Court, since January, 2018 has been granting time to learned counsel for the petitioner for furnishing the surrender certificate. Till date, neither copy of the certificate nor any affidavit has been filed on behalf of the petitioner in the present case.

3. Having regard to the same, the Court finds that the petitioner is taking the Court proceeding for granted. The Court would also note that the matter has been listed on 12 occasions and still the situation remains the same.

4. In view thereof, the Court does not find any justification to continue with the present proceeding. Accordingly, the same stands dismissed.
