09. 04.12.2015 The Petitioner seeks cancellation of anticipatory bail granted to the private Opposite Parties No. 2 to 5 by order dated 01.11.2012 in connection with Kotwali P.S. Case No. 795 of 2010 passed in A.B.P. Nos. 2456 of 2010 and 2506 of 2010 by the Sessions Judge, Bhagalpur on the ground that despite undertaking they have not deposited 25% loan amount before the Court below the appeal was confirmed. For reasons best known, the private Opposite Parties came before this Court and once again they

Patna High Court Cr.Misc. No.49185 of 2013 (9) dt.04-12-2015 undertook to deposit the amount. However, they did not do so. In view of such, the anticipatory bail granted to the private Opposite Parties No. 2 to 5 by order dated 01.11.2012 in connection with Kotwali P.S. Case No. 795 of 2010 passed in A.B.P. Nos. 2456 of 2010 and 2506 of 2010 by the Sessions Judge, Bhagalpur is, hereby, cancelled.

The Court below is directed to take stringent steps for ensuring arrest of the private Opposite Parties. The Application is allowed with the aforesaid observations.
