JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/307/333/337/353/427/380/452/435/436/504 /506/120B of the Indian Penal Code, 27 of the Arms Act and 3/4 of The Prevention of Damage to Public Property Act,1984. Prosecution case is that 25 FIR named accused persons and 1000 unknown entered into the premises of the police station breaking the furniture, damaged the public property, raised slogan against the police officials and ransacked the nearby shops. It is submitted by learned counsel for the petitioner that the accusation is omnibus and general. In fact, the mob was protesting against the in action of the police since one boy went
Patna High Court Cr.Misc. No.3029 of 2016 (2) dt.19-01-2016 2/2 traceless and subsequently his dead body was recovered. Moreover, similarly situated co-accused Rishi Kumar Paswan has been granted anticipatory bail by a co-ordinate Bench of this Court vide Criminal Miscellaneous No.22079/2015 and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhubani in connection with Khajauli P.S. Case No.169/2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
