1. Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel appearing on behalf of Department of Mines, Sri Naresh Dixit.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 132, 61(2), 303(2), 317(2) and 62 of the B.N.S., 2023.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that 145 cubic feet of illegally mined sand was apprehended and tractor along with trailer seized, further the receipt shown was found invalid under Bihar Minor Mineral Concession Rules.
4. Learned counsel for the petitioner submits that petitioner was not apprehended from the spot as such nothing
Patna High Court CR. MISC. No.37044 of 2026(3) dt.18-06-2026 2/2 was recovered from his conscious possession and he came to be implicated based on the fact that he is owner of the seized tractor. It is further submitted that the petitioner was completely unaware that his driver would misuse his vehicle in the manner as alleged but then it is submitted that the fine has been paid.
5. Learned counsel appearing on behalf of the Department of Mines does not dispute the submission of the learned counsel appearing on behalf of the petitioner that fine has been paid by the petitioner.
6. After hearing the learned counsel for the parties, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Piprahi P.S. Case No.38 of 2026, subject to the conditions as laid down under Section 482(2) B.N.S.S.
