JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 341, 448, 436, 354, 504/34 of the Indian Penal Code.
It is alleged that the accused persons came and started searching husband of the informant. It is specifically alleged that petitioner No.3 sprinkled kerosene oil on the hutment of the informant and petitioner 2 lit the fire. It is alleged against petitioner No.1 that she caught hold of baby of the informant and asked the accused persons to throw the baby in fire. It is submitted by the learned counsel for the petitioners that at earlier point of time daughter-in-law of the petitioner No.1
Patna High Court Cr.Misc. No.2610 of 2016 (2) dt.18-01-2016 2/2 and 3 was assaulted at the hands of informant side leading to lodging of Neemachandpura P.S. case No. 51 of 2015 against the informant side thereafter the present case has been lodged. Considering the fact that petitioner No.1 is a lady and accusation of litting fire is not against her, let the petitioner No.1, Manju Devi, be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar, learned JM, 1st class, Begusarai in connection with Neemachandpura P.S. Case No. 59 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
Considering the fact that case lodged by the petitioners' side was an earlier point of time, let the learned court below consider the prayer for regular bail of the petitioner Nos. 2 and 3 in case they surrender within six weeks from today in connection with the aforesaid case.
This application is disposed of with the aforesaid direction.
