2. The petitioner is in judicial custody in connection with Marhowraha P.S. Case No. 103 of 2022 registered under Sections 341, 323, 324, 325, 307, 379, 504, 506 and 34 of the Indian Penal Code lodged on 19.02.2022 by the informant, Munna Kumar Gupta.

3. As per the prosecution story, the allegation is that the father and son both went to the informant's place and so far as this petitioner is concerned, he gave knife blow to the brother of the informant on the nose, hand and also in the stomach causing profuse bleeding. The further allegation against his father Satyendra Singh is os using 'iron rod' to assault the informant's brother.

4. In this case, case diary was called for by a coordinate Bench of this Court vide order dated 24.06.2023 which has since been received.

5. Learned APP has taken this Court to the injury report to show that the injuries on the person of the brother of the informant, two of the three have been found to be grievous in nature.

6. Learned counsel for the petitioner submits that the accused Satyendra Singh is ill and the petitioner is the only son to take care of him.

7. Satyendra Singh himself is an accused and as per the petitioner, he is a landlord. The said submission cannot be a alibi to release the person on bail when the specific allegation is that he has inflicted grievous injury to the informant's brother which has come in the injury report.

8. Taking into account the aforesaid facts, for the present, this Court is not inclined to grant him privilege of bail. (Rajiv Roy, J) Jagdish/- U T
