2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 461 and 379 of the IPC . 3 . As per prosecution case , this petitioner with one other co-accused person committed theft of 150 bundles of cloth worth Rs. 45 lakhs from the go-down of informant and CCTV camera installed in the firm of informant was also damaged by accused persons.

4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., and has falsely been implicated in this case . Nothing has been recovered from conscious possession of the petitioner.

5 . Learned counsel for the State opposed the prayer

Patna High Court CR. MISC. No.38405 of 2024(4) dt.12-09-2024 2/2 for bail and submitted that during course of investigation it has come that this petitioner along with other co-accused persons were seen in the CCTV footage while entering the go-down of the informant.Petitioner has got two criminal antecedents of similar nature .

6. Considering the nature of accusation , criminal antecedents and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected.
