The petitioners seek pre-arrest bail in connection with Sri Nagar (Pujaha) P.S. Case No. 101 of 2015 registered under Sections 147, 341, 325, 307 and 504 of the Indian Penal Code.
Regard being had to the direct and specific allegation against petitioner no. 1 Raju Prasad that he assaulted with tangi on the head of the informant as a result of which he sustained
Patna High Court Cr.Misc. No.2202 of 2016 (2) dt.18-01-2016 2 / 2 fracture injury, I am not inclined to grant him anticipatory bail. Accordingly, the application for anticipatory bail of petitioner no. 1 Raju Prasad is hereby rejected.
So far as the other two accused persons, namely, Kundeo Mahto @ Pundeo Mahto and Satya Narayan Mahto are concerned, regard being had to the fact that there is no allegation of any overt act against them, in the event of arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, West Champaran at Bettiah in connection with Sri Nagar (Pujaha) P.S. Case No. 101 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
