JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 354, 323, 341, 509/34 of the Indian Penal Code and Section 4 of Protection of Children from Sexual Offences Act.

The prosecution case is that when the informant's daughter went outside to attend the call of nature then the petitioners forcibly kidnapped the daughter of the informant and on alarm being raised, petitioners assaulted the daughter of the informant and fled away threatening to kill her and her father. It is submitted by learned counsel for the petitioners that the FIR was lodged on 21.06.2015 which reached to the Court of Judicial Magistrate on 30.06.2015, which reflects that by

Patna High Court Cr.Misc. No.1411 of 2016 (2) dt.12-01-2016 antedating the FIR has been lodged, however, no date of occurrence has been mentioned in the FIR.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if he surrenders within a period of six weeks in connection with Rajnagar P.S. Case No. 116 of 2015 pending in the Court of CJM, Madhubani.

Accordingly, the application is disposed of.
