The petitioner seeks bail in anticipation of his arrest in connection with Bhagwanpur P.S. Case No. 148 of 2020 instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
223 litres of liquor is said to have been recovered from a vehicle. Three persons are said to have run away from the place of raid. The petitioner is stated to be one of them.
Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.33632 of 2020(2) dt.15-03-2021 2/2 that this kind of implication of the petitioner is based on no material fact or evidence. The petitioner has clean antecedents and because of some ulterior motive, his name has been provided to the police and this is the basis for prosecuting him in the present case.
Considering the aforesaid facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge, (Excise Act), Begusarai, in connection with Bhagwanpur P.S.
