The petitioner seeks bail in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant named the petitioner along with other accused persons and alleged that all the accused persons caught his brother Upendra Yadav. Binay Paswan pierced Gupti in the abdomen of Upendra Yadav and Pappu Paswan assaulted on his back side of his head with Pharsa and thereafter all other accused persons are alleged to have assaulted Upendra Yadav. It is submitted that on account of injuries found on head and abdomen the deceased died. Similarly situated accused Ajay Paswan has already been enlarged on bail vide orders passed in Cr. Misc. No. 51290 of 2014. The case of the petitioner stands on

Patna High Court Cr.Misc. No.44189 of 2015 (2) dt.23-09-2015 2/2 the same footing as it appears that no specific allegation of assault is made against the petitioner.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in Jamui P.S. Case No. 117 of 2012.
