The petitioner is languishing in custody for the offences punishable under Sections 376(ch)(Ta)(Da)(Dha)/ 376(F) (K)(m)(n)/341/323/506/34 of the Indian Penal Code. The petitioner is father-in-law of the informant. The F.I.R. reveals that though there is allegation of commission of rape by the petitioner more than once. However, the F.I.R reveals that wife of the petitioner or husband of the informant did not pay any heed to the complainant; rather they asked complainant to leave the house.
Submission is that the informant is second wife of the
Patna High Court Cr.Misc. No.50721 of 2017 (8) dt.23-04-2018 P2/ son of the petitioner. For family dispute and just to pressurize for property the false case has been lodged.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Narhat P.S. Case No. 45 of 2017 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
