The petitioner in this case is seeking anticipatory bail in connection with Jaynagar P.S. Case No.695 of 2018 registered for the offences punishable under Sections 341, 323, 325, 307, 504, 427/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has no concern with the alleged occurrence. Learned counsel submits that the allegation of assault against the petitioner is general and omnibus and he has no criminal antecedent.
Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.
Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.34099 of 2019(4) dt.27-09-2019 2/2 wherein there are allegations that this petitioner had iron rod in his hand from which he had assaulted the informant along with co-accused and the injury report produced before this Court shows multiple injuries in the nature of grievous injuries on the body of the informant, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer is refused.
In case the petitioner surrenders in the court below within a period of four weeks from today and prays for regular bail, his prayer for regular bail shall be considered on its own merit without being prejudiced by the order of this Court. (Rajeev Ranjan Prasad, J) arvind/- U T
