JUSTICE RAKESH KUMAR ORAL ORDER 03-05-2017 Heard Sri Ram Sandesh Roy, learned counsel for the petitioner and Sri Vinay Kirti Singh , learned senior counsel, assisted by Sri Ranjeet Sinha, learned counsel for the officials of Bihar State Electricity Board.
The present petition was filed with a prayer to initiate contempt proceeding against opposite parties on an allegation of willful disobedience to an order dated 26.06.2013 passed in C.W.J.C. No. 12805 of 2007. By the said order Annexure '3' to the writ petition was set aside and it was directed that retirement of the petitioner shall be deemed on the basis of date of birth
Patna High Court MJC No.149 of 2014 (10) dt.03-05-2017 2/2 recorded in the service book as 23.06.1949 and petitioner was held to be entitled to get all consequential benefits. After filing of the present petition show cause and supplementary show causes were filed and it has categorically been stated that the order of the writ court has already been complied and even in view of the 6th Pay Revision Commission Report basic pay / salary was also fixed as Rs. 17980/-.
Considering the facts disclosed in the show cause , the Court is satisfied that there is no need to further proceed with the matter.
The petition stands disposed of.
