JUSTICE ARUN KUMAR ORAL ORDER 25-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 24.1.2017, seeks bail in Gurua PS Case No. 11 of 1998 registered under Sections 147, 148, 149, 326, 307, 452, 436, 380, 302 of the IPC, Section 27 of the Arms Act, 3⁄4 of the Explosive Substance Act and Section 17 of the C.L.A. Act.
The allegation in brief is that more than 200 members of the extremist group raided house of the informant, raised slogans, set the house on fire and killed two members of the house. Learned Counsel for the petitioner submits that though the petitioner is named in the FIR, no specific overt act is alleged and identification is alleged to have been done in the light of ablaze of fire which is suspicious, other FIR named accused Mohan Yadav, also a named accused, has been granted bail by a coordinate Bench of this Court and the petitioner has/had no knowledge about this case, however he has been in custody for the last fifteen months. Having considered the said facts and circumstances, the petitioner, namely, Ram Pravesh Paswan @ Kamlesh Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten
Patna High Court Cr.Misc. No.6362 of 2018 (7) dt.25-04-2018 thousand) with two sureties of the like amount each to the satisfaction of SDJM Sherghati, Gaya in connection with Gurua PS Case No. 11 of 1998 with the following conditions:- (i) one of the bailors shall be a close family member of the petitioner; and (ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
