The petitioner is in custody in connection with Deodha P.S. Case No.27 of 2019 for the offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the name of the petitioner surfaced on the confessional statement of the co-accused Mohd. Shamim and Dhayani Mukhiya. Learned counsel further submits that in the instant case total 411.840 liters of liquor was seized but nothing was recovered from the conscious possession of the petitioner, rather the same was recovered from the Mango Ochard of Dhanik Lal Yadav.
Patna High Court CR. MISC. No.35013 of 2019(2) dt.28-05-2019 2/2 Learned counsel further submits that petitioner is in custody since 16.03.2019.
Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge (Excise), Madhubani, in connection with Deodha P.S. Case No.27 of 2019.
