The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

Allegation against the petitioner is that he escaped with the Scorpio vehicle of the complainant, standing in the name of his son.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that nothing has been recovered from the house of the petitioner rather the said vehicle was recovered from the conscious possession of Anil Kumar who is accused in Simri P.S. Case No. 36 of 2018 for the offence under Section 30(a) of

Patna High Court CR. MISC. No.47767 of 2021(2) dt.24-03-2022 2/2 the Bihar Excise Act, 2016 and in that case, the petitioner has not played any role.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Bahadurpur P.S. Case No. 179 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
