JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 06-04-2017 By way of the present application filed under Section 482 of the Code of Criminal Procedure, the petitioner seeks quashing of the order dated 01.05.2001 passed by the learned Judicial Magistrate, 1st Class, Sasaram in Complaint Case No. 238 of 2001 whereby cognizance has been taken against the petitioner under Sections 406, 420 IPC and Section 138 of the Negotiable Instruments Act.

After some arguments, learned counsel for the petitioner seeks leave to withdraw this application in order to file an application under Section 256(2) of the Code of Criminal
