The petitioner seeks bail in Motihari Mahila P.S. Case no. 26/2015, registered for the offences punishable under Sections 366A, 313, 315 and other Sections of the Indian Penal Code. The victim alleged that the petitioner on the pretext of marriage with her established physical relation but later on the petitioner refused to marry with the victim. A Panchayati was also held but the petitioner did not obey the decisions of the Panchas. It is submitted that earlier mother of the victim filed Turkauliya P.S. Case No. 150/09 against Rameshwar Gosai and others under Section 376 and 511 of the Indian Penal Code alleging therein that Rameshwar Gosai and others made attempt to

Patna High Court Cr.Misc. No.44378 of 2015 (2) dt.23-09-2015 2/2 commit rape with her daughter, the informant of the case. The aforesaid case was compromised. The present case is filed only to put pressure on the petitioner so that the petitioner may marry with the victim. The victim is a major girl.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Mahila P.S. Case no. 26/2015.
