The petitioner has renewed the prayer for bail in a case registered for the offences punishable under Sections 18, 20, 21, 22 and 23 of the N.D.P.S. Act.
From the possession of the petitioner 500 grams of Charas was recovered.
Learned counsel for the petitioner submits that the recovery is in between small and commercial quantity and the co-accused have already been acquitted.
Learned APP submits that in one of the cases the petitioner escaped from the jail leading to registration of
Patna High Court Cr.Misc. No.21335 of 2017 (5) dt.25-04-2018 another case against the petitioner.
In view of the serious criminal antecedent of the petitioner as he is in accused in 13 cases of different nature including under Sections 224, 302, 365, 384 of the IPC and the report of Superintendent of Police, West Champaran, Bettiah dated 04.02.2018 which suggests that within six months all the witnesses will be produced for examination, this Court is not inclined to revise the earlier order.
It is expected from the learned trial Court to conclude the trial expeditiously.
Accordingly, the prayer for bail of the petitioner is rejected in connection with Bettiah Town P.S. Case No. 31 of 2010 pending in the Court of learned Additional Sessions Judge 3rd, West Champaran, Bettiah.
