JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-09-2022 The present writ petition has been filed seeking the following reliefs:- "1(i). For direction to the District Magistrate, Bettiah and Sub-Divisional Officer, Narkatiyaganj (Respondent Nos.

2 and 3), for implementing and executing the order dated 17.6.2014, passed by Deputy Collector of Land Reforms, Narkatiyaganj, District-West Champaran, in Case No. 243/13-14, appertaining to Bihar Land Disputes Resolution Act, 2009.

(ii) For commanding the respondent

Patna High Court CWJC No.4087 of 2021(2) dt.29-09-2022 2/3 authorities to immediately remove the encroachment from the public land located in khesra no. 1745 and situated in mauza-Sargatiya, which is being used as a common passage by the villagers.

(iii). For seeking detailed explanation from the respondent authorities as to why they have sat indefinitely and till date due to their vested interests have failed to implement the order passed in BLDR Case No. 243/13-14, and remove the encroachment from the public land kin question"

At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the District Magistrate, West Champaran at Bettiah for redressal of their aforesaid grievances regarding enforcement of the order dated 17.6.2014, passed by the learned Deputy Collector, Land Reforms, Narkatiyaganj, West Champaran, in case no. 243/13-14.

Liberty, so sought is granted.

It is needless to state that in case, appropriate petition is filed by the petitioners

Patna High Court CWJC No.4087 of 2021(2) dt.29-09-2022 3/3 within a period of four weeks from today, appropriate decision shall be taken thereon within a period of twelve weeks, thereafter, in accordance with law.

The writ petition stands disposed off on the aforesaid terms.
