JUSTICE PARTHA SARTHY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 15-09-2023 The writ petition was filed specifically pointing out that the Secretary of the Bihar Legislative Council has to be appointed from the cadre of District and Sessions Judges, which has not been done for long and a person, who is outside the cadre has been appointed.

Patna High Court CWJC No.9449 of 2023 dt.15-09-2023 2/2 informed us that already a request has been made to the High Court to send a panel of three District and Sessions Judges. In such circumstances, we find no reason to keep the writ petition pending. It is the undertaking of the respondents that a person from the cadre of District and Sessions Judge (Super Time Scale) shall only be appointed as the Secretary of the Bihar Legislative Council; which is recorded.

3. Writ petition stands disposed of by recording the above undertaking.
