Petitioner, already in custody, seeks bail in connection with Masaurhi PS Case No.418 of 2015, registered under Sections 304B/34 of the Indian Penal Code.

Allegation in brief is that the daughter of the informant, who happened to be the wife of the petitioner, was tortured in connection with further demand of dowry and she died unnatural death.

Learned counsel for the petitioner submits that it is not the case that the wife of the petitioner was killed and any effort was made to dispose of the dead body rather information was given to her parents and it is a case of natural death; whereas the learned counsel for the State submits that petitioner

Patna High Court Cr.Misc. No.60022 of 2017(7) dt.26-04-2018 2/2 is the husband having specific allegation of committing torture and within two years of marriage, the deceased died unnatural death as FSL report indicates death is due to poisoning. Having considered the aforesaid facts and circumstances, the Court is not persuaded to grant bail to the petitioner, so his prayer of bail is rejected in connection with Masaurhi PS Case No.418 of 2015, pending in the court of learned SDJM, Masaurhi, District Patna.

However, the trial court is directed to expedite the trial and preferably conclude the same within a year. (Arun Kumar, J) S.KUMAR/- U T
