2. The petitioner nos. 1 and 2 are in custody since 13.07.2015 and 22.07.2015 in connection with Pakribarawan P.S.Case No. 254 of 2014 for the offences alleged under Sections 147, 148, 149 and 302 of the Indian Penal Code.
3. It is submitted that the petitioners have been falsely implicated and the F.I.R. has been instituted after a day's delay without explanation for the same.
The accusations are general and omnibus in nature without attributing any specific role to the assailants, much less the petitioners. It is further submitted that similarly situated coaccused Ravindra Yadav and Satish Yadav have been granted
Patna High Court Cr.Misc. No.45791 of 2015 (3) dt.12-02-2016 bail.
4. Heard learned A.P.P, who however, on the basis of the case diary, could not point out any specific role attributed to the petitioners of committing assault.
5. Having regard to the entirety of the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nawada in connection with Pakribarawan P.S. Case No. 254 of 2014.
