The petitioner seeks bail in Kacchawa P.S. Case no. 42/2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant named 13 persons including the petitioners and alleged that they all assaulted her husband Sikander Sao. Poonam Devi put nail in his foot and Kamna Devi assaulted her husband on his testicle. Consequently her husband died. It is submitted that Kamana Devi, Poonam Devi, Karait Rajwar and Sitaram Rajwar have already been enlarged on bail by the learned II Additional Sessions Judge as well as learned III Additional Sessions Judge. The case of the petitioner stands on the

Patna High Court Cr.Misc. No.43570 of 2015 (2) dt.21-09-2015 2/2 same footing.

It appears that there is no allegation of assault against the petitioner rather omnibus and general allegation of assault with lathi is made against all the 13 accused persons but Poonam Devi is alleged to have put nail in the legs of the deceased and Kamana Devi is alleged to have assaulted the deceased on his testicle, but they have already been enlarged on bail.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Basant Kumar, Judicial Magistrate 1st Class, Bikramganj, Rohtas, in connection with Kacchwa P.S. Case no. 42/2014.
