JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2019 This application, for grant of anticipatory bail, arises out of Mirganj P.S. Case No. 12/2019, disclosing offences under Sections 304(B)/34 of the Indian Penal Code. Petitioner happens to father in law, brother in law and two sisters in law of the deceased and allegation against them and others is of causing death of the deceased in connection with demand of dowry.

Submission of learned counsel for the petitioners is that they are in laws of the deceased and no specific allegation has been attributed to them and para -11 of the case diary,

Patna High Court CR. MISC. No.35692 of 2019(4) dt.09-08-2019 2/2 wherein, statement of a witness has been recorded, which shows that the deceased died due to illness and postmortem report disclose the cause of death is heart failure and considering the same husband of the deceased has been enlarged on bail by a coordinate Bench of this Court vide order dated 17.05.2019 passed in Cr. Misc. No. 30453 of 2019.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XVI, Gopalganj/concerned court, where the case is pending in connection with Mirganj P.S.
