JUSTICE SATYAVRAT VERMA ORAL ORDER 10-12-2021 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of Covid 19 pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 190 of 2021 registered under Sections 30 (a)/30(b) of the Bihar Prohibition and Excise (Amendment) Act, 2018 read with Sections 272 & 273 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.06.2021, and is a person of

Patna High Court CR. MISC. No.45374 of 2021(2) dt.10-12-2021 2/2 clean antecedent and charge-sheet has been submitted. Allegation is of recovery of 40 litres of liquor from the land of other co-accused and this petitioner has been falsely implicated based on the information provided by the Chowkidar. Learned counsel submits that the Chowkidar because of village politics had implicated this petitioner.

Learned APP for the State opposes the prayer of regular bail application of the petitioner.

Considering the fact that the petitioner is in custody since 25.06.2021. Learned counsel submits that the petitioner, is a person with clean antecedent and no concern with that, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran, in connection with Chanpatia (Sirisiya O.P.)
