JUSTICE ARUN KUMAR ORAL ORDER 25-06-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner, already in custody, seeks bail in connection with Yogapatti P. S. Case No. 326 of 2016, registered under Sections 147, 148, 149, 323, 324, 307, 302, 447 and 504 of the Indian Penal Code.

The allegation in brief is that the son of the informant was assaulted by petitioner and other co-accused, Ajay Yadav and Chandra Dev Yadav.

Learned counsel for the petitioner submits that there is land dispute between both sides and cause of the death is injury on the head of the son of the informant and no corresponding injury is found on the back of the deceased, caused by the lathi by

Patna High Court Cr.Misc. No.22677 of 2017 (3) dt.25-06-2018 2/2 the petitioner, Bhushan Yadav, who is in custody since 16.01.2017. It is further submitted that the petitioner has clean antecedent.

Having considered the said facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, west Champaran, in connection with Yogapatti P.S.Case No. 326 of 2016.
